Dream Home Property & Investment (“Dream Home”) operates both as a property developer and as a marketing agency. When acting as a marketing agency, Dream Home is compensated by builders for connecting potential clients with their projects. Please be aware of the following when Dream Home is acting in this capacity:
- Responsibility for Delays and Issues: Dream Home is not responsible for any delays, cost increases, or issues caused by external parties such as land agents, builders, finance brokers, lawyers, SDA providers, single part contract sellers or developers, or any company involved in property management. Any loss of money or inconvenience resulting from delays or issues with these external parties is not the responsibility of Dream Home.
- Accuracy of Information: The prices and information listed on the Dream Home website may be outdated or inaccurate. Clients should not assume that the information provided is current or correct. It is essential to verify all details directly with relevant parties before making any decisions.
- Feasibility of Building: Do not assume that a house can be built on a particular land solely based on marketing materials or brochures. Generic brochures are often designed for promotional purposes and may not reflect the specific requirements or feasibility of the project. It is crucial to conduct thorough checks with the building team to confirm the feasibility and compliance of the construction.
- Due Diligence Required: Clients are strongly advised to conduct their own comprehensive due diligence before entering into any land contract with land developers or building contracts with builders. Dream Home does not guarantee or assume responsibility for the terms, conditions, or performance of any contracts made between clients and builders or land developers.
- SDA Property and Returns: Dream Home does not guarantee any returns or performance for SDA (Specialist Disability Accommodation) properties. The agreement concerning SDA properties is solely between the client and the SDA provider. Dream Home provides information on demand areas for SDA properties based on details supplied by the SDA provider. Clients should directly consult with SDA or SIL (Supported Independent Living) providers regarding demand and other relevant factors in the area.
- Agency Role: When functioning as a marketing agency, Dream Home’s role is limited to facilitating connections between clients and builders. We do not influence or participate in the contractual agreements or construction processes between clients and builders. This applies to all projects, including those managed by other builders.
- Indemnity and Liability: Clients agree that they cannot claim or seek compensation from Dream Home for any losses incurred during dealings with builders, land developers, mortgage brokers, SDA providers, single part contract sellers or developers, or any company involved in property management. Dream Home will not be liable for any such losses or damages.
- Marketing Agency Payments: Marketing agencies working with Dream Home are compensated when Dream Home receives payment from the builder. This arrangement does not imply any influence over the contractual terms or construction processes.
- Changes by SDA Providers: Dream Home is not responsible for any changes made by the SDA provider to their terms or conditions, either during or after the construction process, due to any unforeseen circumstances.
- SMSF Contracts: Companies making single contracts for SMSF (Self-Managed Super Funds) are solely responsible for the SMSF or the single contract. Dream Home is not in any capacity to advise on SMSF matters. We simply refer clients looking to purchase through their SMSF to providers who can consolidate two-part property contracts into a single contract.
By proceeding with any recommendations or referrals made by Dream Home, clients acknowledge and accept these terms. We recommend seeking independent legal and financial advice to ensure that all aspects of your contracts and construction projects are thoroughly understood and agreed upon.
